FREQUENTLY ASKED QUESTIONS

The Bucharest City Hall has the obligation to ensure that DDD treatments are carried out only at the public and private objectives of the locality. These are included annually in the Unitary Action Program (PUA), by categories of objectives, for each type of treatment. Natural and legal persons have the obligation to provide DDD operations on the premises they own (HORECA industry, supermarkets, housing, etc.). In order to have a uniform treatment at the level of the Municipality of Bucharest, these treatments must be carried out by legal entities at the same time as the PUA treatments, otherwise they risk fines between 2000-10000 Ron. For more details see point 9.

PUA 2023 contains treatments for deratization (rats), disinsection (adult mosquitoes, larval mosquitoes, ticks, wasps, cockroaches) and disinfection. Treatments against cockroaches and wasps are carried out only on request, in case of an outbreak/nest.
Treatments against other vectors (e.g. fleas, mice, etc.) are not provided from the PMB budget, and are the responsibility of the owners’ associations, economic agents, individuals.

All products used to perform pest control, pest control and disinfection operations in Bucharest are approved by the National Commission for Biocidal Products of the Ministry of Health and are used according to the instructions in the Certificates of Authorization:

The activity and obligations of the DDD are regulated by the following normative acts:

  • Law no. 101/2006 (establishes the general framework for the regulation of pest control, pest control and disinfection);
  • ANRSC Order no. 82/2015 on the approval of the Framework Regulation of the sanitation service of localities (establishes obligations for local public administrations regarding the DDD treatments and the approval of the PUA);
  • Law no. 95/2006 on health care reform (establishes obligations for employers regarding DDD treatments);
  • Government Decision no. 857/2011 on the establishment and sanctioning of contraventions of public health rules (establishes fines for individuals and legal entities in case of non-compliance with the obligation to perform DDD treatments);
  • Order of the Minister of Health No. 119/2014 for the approval of the hygiene and public health norms on the living environment of the population (norms on performing DDD operations).

OBLIGATIONS:

  • Allow CMEIB SA access to the sites where PUA DDD operations are to be carried out;
  • To allow the CMEIB SA information on the date of the DDD operation, the type of treatment, the substances used and their toxicity to be displayed in a visible place;
  • Maintain the premises on which they own property in a sanitary condition, taking measures to remove all solid waste, to wash rooms where waste is collected, to remove stagnant water, to clean basements, to tidy up material storage areas and to remedy technical faults in sanitary installations that cause flooding or stagnation of water in basements and/or on land owned.

  • According to the Service Regulation:
  • To ensure that regular pest control and extermination operations are carried out in the premises they own;
  • Carry out regular pest control and extermination operations in conjunction with the operations carried out by CMEIB SA, as set out in the PUA (see attached briefing);
  • Allow CMEIB SA access to the sites where PUA DDD operations are to be carried out;
  • Maintain the premises on which they own property in a sanitary condition, taking measures to remove all solid waste, to wash rooms where waste is collected, to remove stagnant water, to clean basements, to tidy up material storage areas and to remedy technical faults in sanitary installations that cause flooding or stagnation of water in basements and/or on land owned;
  • According to Law 95/2006:
  • Art. 38. – Any (…) legal person (…), having the capacity of employer, is obliged to provide the necessary funds and conditions for: b) the application of hygiene, disinfection, disinsectization and periodical deratization measures;
  • According to Order no. 119/2014 for the approval of the hygiene and public health rules regarding the living environment of the population:
  • Art. 50. – (…) disinfection, disinsectisation, (…) shall be carried out in compliance with the following conditions: b) Periodic disinsectisation shall be carried out at intervals set out in the methodologies, but not exceeding 3 months, and periodic deratization shall be carried out at intervals of maximum 6 months; between the periodic operations, current disinsectisation and maintenance procedures shall be applied, depending on the presence of vectors.

  • According to the Service Regulation:
  • According to Art. (2) of Annex no. 2 of the H.C.G.M.B. no. 252/2019 – Sanitation Service Regulation – pest control, pest control and disinfection activities: (1) Failure to comply with the provisions of the Sanitation Service Regulation – pest control, pest control and disinfection activities by legal entities constitutes a contravention and is punishable with a fine from 2,000 to 4,000 lei.
  • According to the Government Decision no. 857/2011 on the establishment and sanctioning of contraventions of public health rules:
  • Art. 57. – The following constitute contraventions and are sanctioned with a fine from 3.000 lei to 8.000 lei the following acts committed by legal entities:
  • failure by keepers to apply measures to prevent and control insect and rodent vectors in establishments of any type;
  • failure to control insects and rodent vectors and nuisance-producing insects and rodents in establishments of any type.
  • Art. 58. – The following constitute contraventions and are sanctioned (…) with a fine from 5.000 lei to 10.000 lei for legal persons the following acts:
  • non-compliance by establishments providing disinfection, disinsection and pest control services with the technical rules for the application of biocidal products;
  • provision of pest control and extermination services by unqualified and unlicensed persons;
